Understand this area of law
Personal injury is a broad label that may cover workplace incidents, motor accidents, public liability, medical treatment or other circumstances. Schemes, processes and time limits differ by claim type and jurisdiction. A focused enquiry states where and when the event occurred, what process has already begun and whether any formal notice has arrived.
Define the work before comparing firms
Ask whether the law firm handles the relevant claim type and scheme, and whether the proposed work begins with eligibility advice, an application, negotiation or litigation. Confirm who would supervise the matter and how medical, factual and financial evidence would be obtained. Published area-of-law labels and fee language are not a prediction of eligibility or outcome.
Prepare a safer, more useful first enquiry
Keep correspondence, reports, receipts and a chronology, but do not upload medical or identifying information to a public search. Ask the office which documents are appropriate for an initial review and how they should be sent. Discuss charging methods, disbursements, adverse-costs risks where relevant and what happens if the firm cannot accept the enquiry.
Work that may sit within this category
Use these examples to describe the enquiry, not to diagnose the legal issue or assume that every law firm performs the work.
- Workplace injury and workers’ compensation
- Motor-vehicle, public-liability or occupier claims
- Medical-treatment concerns
- A rejected claim, review or settlement proposal
Information to organise before making contact
- A chronology including where and when the event occurred
- Insurer, scheme or employer correspondence and claim numbers
- A list of reports and expenses held, without uploading medical documents here
Notification and claim periods vary by scheme and jurisdiction. Do not use a general limitation period from a webpage as a calculation for your circumstances.
Take to the conversation
Three questions for a lawyer
- Does the firm handle this claim type under the relevant state or federal scheme?
- What information is needed to assess the first step and any time concern?
- How are legal fees, disbursements and possible cost risks explained?
